Backgrounds:


Partner and founder member of the law firm, Patrick Kileste has a bachelor in law with a « grande distinction » grade at the Université Catholique de Louvain (UCL). He started his activities at the Brussels Bar in 1983.

He is considered as one of the best specialists of commercial distribution law (concession of sales, franchise, and agency), including the European law aspects. In this area, he has publishes since 1985, among others, case law reviews, a book about 50 years of enforcement of the law of 27th July 1961 about unilateral termination of fixed termed concession of sales contracts.

In car distribution law, he is one of the only lawyers who will accept to assist only the dealer or importer. As such, he is a member of EDL (European Distribution Lawyer), international association of lawyers and representatives of professional federations.

He is an associate member of the Belgian Franchise Federation and was nominated as President of the College of Experts in 2011. He is also a member of the Chamber of Commerce of Brussels.

He is also a specialist of corporate law, particularly concerning the shareholders conflicts resolution.

He has written many scientific publications and is regularly a speaker in his fields of specialty.

He intervenes also as a national or international arbitrator and is member of CEPANI (Belgian Arbitration and Mediation Center), and member of its Legal Committee.

Passionate about the alternative dispute resolution, he did several trainings in this area, including principled negotiation and non-violent communication.

Those trainings enable him to assist effectively his clients in any negotiation, even in other fields of law, like for instance inheritance conflicts.

He did a mediation training at the Brussels Business Mediation Center (BBMC now bMediation) and is a certified mediator in civil and commercial fields. He is a member of the Mediation Commission of the Brussels Bar.

He is also a teacher in those areas.

Convinced of the crucial position that the lawyer might have in an awakening of the consciences to human relationships based on respect of the needs of everyone, he has been one of the promoters of the study day organized by the Brussels Bar on « Another way to be a lawyer ». He is a member of the Personal Development Institute of the Lawyer.

He speaks French and English and has a good knowledge of Dutch.

Lawyer and certified mediator, she has a master degree in private law and a specialized studies degree (doctorate) in construction law at the University Paris I Panthéon-Sorbonne. She has also a University degree in mediation at the Institut Catholique de Paris, directed by Stephen Bensimon.

After having had management posts in several private and public companies, she joined the Hauts-de-Seine Bar, the Paris Bar and the Brussels Bar, where she has been a member of the Bar Council.

She practices family law, international private law, property law, inheritance law and wills. She also practices civil law and contract law (leases, construction law, …)

She has been trained to negotiation and mediation in the United States (Harvard University), in France and in Belgium (BMediation, PMR on principled negotiation and collaborative law, INC on neuro linguistic programming, MIKK and the European Commission on mediation and international child abduction, La Forestière for a 4 years program on family or institutional systemic intervention, EEPA for a 5 years program), Evelyne Meissirel is a certified mediator in family, civil, commercial and labor fields and is regularly appointed by courts. She teaches mediation and negotiation in Belgium and abroad in several institutions including the Université Catholique de Louvain (UCL), the CAPA, the Royal Belgian Notaries Federation, the Trialogues association, the Mediation and Negociation Training Institute (Ifomène). She also provides trainings for companies or for mediator associations at the request of the European Commission (Algeria, Tunisia) or the Federal Ministry of Justice (Morocco).

She is co-founder, since 2006, of the association Trialogues and responsible of the two years qualifying mediation training since 2013 and is President of the association OMA, international mediation center.

She has recently finished her term as a member of the Brussels Bar Council. She is the President of the Alternative Dispute Resolution Commission at the Brussels Bar and at Avocats.be. She is also member of the Family law commissions.

Because of her experience in those areas as a lawyer, mediator and teacher and her training in psychology, she is able to assist efficiently her clients in any kind of situation and to define the best strategy in these circumstances.

She has written articles about mediation and an essay about prevention and management of psychosocial risks at work. She has adapted in French a German book on international family mediation and international child abduction. She is a speaker in several colloquiums in Belgium and abroad.

Cécile Staudt has obtained, with a « grande distinction » grade, in 2001, her bachelor in law at the Université Libre de Bruxelles (ULB). In 2002, she obtained, also with a « grande distinction » grade, a complementary degree in European law at the European Studies Institute (ULB).

In 2002, she began her career as a lawyer at the Brussels Bar and specialized in business law and in particular in corporate law, distribution law (concession of sales, agency, franchise) and Belgian and European competition law.

Brilliant lawyer, she is also a teaching assistant at the Université Libre de Bruxelles (ULB) for the courses of « obligations » and « contracts ». She has also been a teaching assistant for the course of « Introduction to private law » between 2001 and 2007.

She has an important scientific activity. She has written several publications and she regularly participates as a speaker in lectures.

In 2015, Alice Dejollier has obtained a master degree in law, with a « distinction » grade, at the Catholic university of Louvain (UCL). Prior to that, in 2013 and 2014, she has followed two trainings relative to the « alternative dispute resolution ».

In 2016, she has worked for the firm Deloitte in Luxembourg, before becoming academic assistant at the Catholic university of Louvain in patrimonial family law. She became a member of the Brussels Bar in September of the same year.

She’s currently undertaking the publication of articles on « med-arb », an alternative method of conflicts resolution combining mediation and arbitration..

Distribution and competition law

Patrick Kileste and Cécile Staudt are particularly active in the area of commercial distribution law, at the national and European levels. They regularly act on behalf of car dealers associations or car dealers; they help franchisors for the implementation of their network; they provide assistance to franchisors and to franchisees for the management of their relations and to principals and sales agents or other parties involved in the distribution sector.
They are also specialized in competition law and in international private law and often interact with commercial distribution law.
They have published several books in the fields of commercial partnership agreements, i.e. sales concessions agreements, franchise and commercial agency. They have also drafted case law chronicles on concession of sales for more than 25 years and regularly write articles or commentaries on courts decisions in the most prestigious Belgian law reviews (Journal des Tribunaux, Revue de Droit Commercial, Revue Critique de Jurisprudence Belge, JLMB). They give regularly lectures in those areas.
